Terms and Conditions

These Terms and Conditions (“Terms”) govern all purchases made through Perfect Wine Club Ltd trading as Burgundy Wine Club (“we”, “our”, or “us”), whether by individual customers for personal use (“Consumer Customers”) or by commercial or business entities purchasing for trade purposes (“Trade Customers”). By placing an order via our website or through our team, you agree to be bound by these Terms.

Please read them carefully before making a purchase. If you do not accept these Terms, you should not proceed with your order.

2. Eligibility & Age Restriction

2.1 You must be at least 18 years old to purchase alcoholic products from us. We reserve the right to request valid ID before or upon delivery.

2.2 Trade Customers must register a valid business account and will be required to provide company details, VAT registration, and/or proof of trading.


3. Contract Formation

3.1 All orders are subject to acceptance and availability.

3.2 A binding contract is formed only once we have confirmed your order in writing (including via email).

3.3 We reserve the right to cancel or reject any order without explanation, particularly in cases of suspected fraud, payment issues, or breach of these Terms.


4. Prices & Payment

4.1 All prices are listed in GBP (£). They may be inclusive or exclusive of VAT and/or duty, which will be clearly indicated.

4.2 Prices are subject to change without prior notice. The price payable is the price stated on our website at the time of your order (unless in error).

4.3 Payment is required in full at the time of ordering unless otherwise agreed in writing.

4.4 Trade Customers may apply for a credit account subject to approval, credit checks, and agreement to additional trade terms.


5. Delivery

5.1 Delivery dates are estimates and not guaranteed. We are not liable for delays due to third-party couriers or events beyond our control.

5.2 Goods are at your risk from the point of delivery. Title to goods passes only upon receipt of full payment.

5.3 All deliveries of age restricted products must be accepted by a person aged 18 or over. We may request age verification on delivery.

5.4 Delivery charges and thresholds for free delivery will be communicated at checkout or upon account setup.

5.5 If your order qualifies for free delivery based on a minimum spend threshold and you later return item(s) that reduce the order value below that threshold, we reserve the right to deduct the standard delivery charge from your refund.

5.6 Deliveries Left at Customer’s Request: If you ask us to leave your order in a designated ‘safe place’ or with a third party, this is done entirely at your own risk. Once the goods are delivered in accordance with your instructions, we cannot accept liability for any loss, damage, or theft that may occur.

6. Pre-Order & En Primeur Wines

6.1 Availability: Pre-order and en primeur wines are offered in advance of their official release or arrival. The estimated delivery window will be provided at the time of purchase. However, please note that delivery times are subject to change due to factors beyond our control, such as delays in release schedules or shipping conditions.

6.2 Payment: Payment for pre-order and en primeur wines is taken at the time of ordering to secure your allocation. By placing a pre-order or en primeur order, you agree that this is a final commitment to purchase, and payment will be processed immediately.

6.3 Delivery, duty and VAT: The payment for delivery, duty, and VAT for any pre-order or en primeur wines will be charged separately at the point the wine enters the UK and is ready for delivery, in line with the applicable rates at that time. Payment must be made in full within 30 days of invoice. If payment is not received within this timeframe, we reserve the right to:

  • Withhold delivery of the wine until payment is made,

  • Charge storage fees for any delay beyond the 30-day period, and/or

  • Cancel the order, in which case we may retain all or part of the original purchase price to cover costs incurred, including any resale losses or administrative fees.

We will make reasonable efforts to contact you before taking any such action.

6.4 Cancellation & Refunds: Orders placed for pre-release or en primeur wines are non-refundable and cannot be cancelled once confirmed, as the wines are allocated specifically for you. In the rare event that a wine becomes unavailable or cannot be delivered, a full refund or account credit will be issued. If goods arrive damaged or are found to be faulty, you must inform us within 24 hours of receipt. We will offer a replacement, refund, or credit, as appropriate. Any compensation will be strictly limited to the original purchase price and will not reflect any potential or perceived increase in the wine’s future market value.

6.5 Delivery: The estimated delivery window for pre-order and en primeur wines is based on information available at the time of your order. However, delivery dates may change. We will update you on the progress of your order and notify you of any significant delays.
Delivery for pre-order and en primeur wines will be arranged once the wines have landed in the UK. At that point, delivery charges, duty and VAT will be calculated and invoiced separately.

6.6 Returns: Pre-order and en primeur wines are non-returnable unless damaged or faulty upon delivery. If your wine arrives in a damaged or faulty condition, please contact us within 24 hours of delivery. We will work with you to resolve the issue, offering either a replacement, refund, or credit.


7. Cancellation & Returns

7.1 Any of these return terms do not affect your statutory rights.

7.2 Any return not arranged directly by us must be returned to: Perfect Wine Club Ltd, Rayner Lane, Ashton-under-Lyne, Greater Manchester OL7 0FU.

7.3 Items must be securely packaged and appropriately insured, as we cannot be held responsible for goods lost or damaged in transit.

Consumer Customers:

7.4 You have the legal right to cancel your order within 14 days from the day after you receive your goods.

7.5 Goods must be returned unopened, undamaged, and in a resaleable condition. You are responsible for return shipping costs.

7.6 Refunds will be made within 14 days of receiving the returned goods, to the original payment method or credited to your account.

Trade Customers:

7.7 Returns are not accepted without prior written agreement and are subject to restocking fees.

7.8 Any discrepancies or damages must be reported within 48 hours of delivery.

7.9 We do not accept returns for overstock or unsold items.


8. Faulty or Damaged Goods

8.1 If goods arrive damaged or are found to be faulty, you must contact us within 24 hours with details and photos.

8.2 We may offer a replacement, refund, or credit at our discretion.

8.3 We may request return of faulty items for inspection before resolving the issue.


9. Intellectual Property

9.1 All content on our website (including, but not limited to, branding, text, images, product descriptions, and layout) is the property of Perfect Wine Club Ltd or its licensors.

9.2 You may not copy, use, or distribute our content without written permission.


10. Liability

10.1 We are not liable for indirect or consequential losses, including loss of profits or business.

10.2 Our total liability in relation to any claim shall not exceed the price paid for the goods in question.

10.3 These Terms do not exclude liability for death or personal injury caused by our negligence or fraud.


11. Force Majeure

11.1 We are not liable for failure to fulfil obligations caused by events beyond our reasonable control, including acts of God, strikes, shipping disruptions, supplier failures, or adverse weather.


12. Promotions & Discounts

12.1 Promotional offers are subject to availability and may be withdrawn or amended at any time.

12.2 Promotions are non-transferable, non-exchangeable and cannot be redeemed for cash.

12.3 Some offers may be limited to specific products or customers and cannot be combined unless stated.

12.4 Where a discount or promotional offer was applied to an order, and a part of that order is returned, we reserve the right to adjust the refund amount if the return invalidates the original offer conditions.


13. Data Protection & Privacy

13.1 We will process your personal data in accordance with applicable data protection laws and our Privacy Policy.

13.2 Your data may be used for order fulfilment, account management, and, where consented, marketing communications.


14. Trade Terms

14.1 Trade Customers may be subject to additional terms and credit agreements, which will be provided upon account setup.

14.2 We reserve the right to withdraw credit facilities or adjust terms at any time.

14.3 Resale or export of goods must not occur without our prior written consent and must comply with applicable alcohol laws.

14.4 Quality Assurance and Reporting Faults: We strive to deliver wines of the highest quality and expect them to arrive in excellent condition. If you believe a wine is corked or otherwise defective:

  • Contact us promptly at trade@burgundywineclub.co.uk with a description of the issue.

  • Please include full details: producer, wine name, vintage, and, where possible, the batch or lot number.

  • Attach a clear photograph of the bottle and let us know the date it was opened.

  • Keep the bottle for at least 7 days after reporting the fault. In some instances, we may arrange collection for further examination.

If we do not receive the required information or the bottle is no longer available for inspection within that timeframe, we may be unable to issue a credit or replacement.

14.5 All deliveries must be inspected by the Trade Customer at the time of receipt. Any discrepancies, breakages, or missing items must be reported to us within 48 hours of delivery. Failure to notify us within this period may result in claims being refused. Signing for a delivery shall be deemed acceptance of the goods as delivered, unless damage or issues are noted at the time.


15. Governing Law, Jurisdiction and Use of Goods

15.1 These Terms are governed by the laws of England and Wales.

15.2 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Wines purchased by Consumer Customers are strictly for personal use. Resale or export is prohibited unless explicitly agreed in writing. All purchases must comply with relevant UK alcohol and licensing laws. Breaches may result in account suspension or order refusal.
